Right of Withdrawal/ Cancellation Policy

1 Right of withdrawal of a client as a consumer

1.1 The following right of revocation exists only for a client who is a consumer in distance selling. Thereafter, the client is entitled to a fourteen-day right of withdrawal in accordance with the statutory provisions.

1.2 The right of withdrawal expires when Creating Atmospheres has completely performed the service and has only started to perform the service after the client has given his explicit consent and at the same time confirmed his knowledge that he loses his right of withdrawal upon complete fulfillment of the contract by Creating Atmospheres (§ 356 paragraph 4 u. 5 BGB).

1.3 The declaration of consent to be provided reads:

"I agree and expressly request that Creating Atmospheres begins with the execution of the ordered service before the end of the cancellation period. Furthermore, I am aware that I lose my right of withdrawal upon complete fulfillment of the contract by the organizer."

1.4 In the event that the customer cancels the service agreement prior to the complete provision of the service by Creating Atmospheres (i.e. prior to the expiry of the right of cancellation described above), the customer will owe compensation for the value of the partial services provided up to the time of cancellation (Section 357 (8) BGB).

1.5 In all other respects, the provisions set out in detail in the following cancellation policy shall apply to the right of cancellation:

Cancellation policy

You as a consumer have the right to revoke this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day of the conclusion of the contract.

To exercise your right of withdrawal, you must inform us (Creating Atmospheres, Rüsselsheimer Allee 8, 55130 Mainz, Germany, e-mail: dw@creating-atmospheres.com, phone: 0170 612 8520) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post). You can use the attached sample withdrawal form for this purpose, which is, however, not mandatory.

To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

2 Consequences of revocation

2.1 If you revoke this contract, we shall reimburse you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered by us), without undue delay and no later than within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment.

2.2 The right of withdrawal shall expire prematurely if we have provided the service in full and have only begun to provide the service after you have given your express consent to this and at the same time confirmed your knowledge that you will lose your right of withdrawal upon complete fulfillment of the contract by us.

2.3 If you have requested that the services begin during the revocation period, you shall pay us a reasonable amount corresponding to the proportion of the services already provided up to the point in time at which you notify us of the exercise of the right of revocation with regard to this contract compared to the total scope of the services provided for in the contract.

3 Digital content

3.1 The right of revocation shall expire in the case of a contract for the delivery of digital content not on a physical data carrier if we have commenced performance of the contract after you have expressly consented to our commencing performance of the contract prior to the expiry of the revocation period and you have confirmed your knowledge that by consenting you lose your right of revocation upon commencement of performance of the contract.
